Terms & Conditions

1. About us and these terms

1.1 This website is operated by VapeSupplier Ltd, trading as vapevapevape.co.uk ("we", "us", "our"), a company registered in England and Wales under company number 10873335, with its registered office at 33 Bennetts Hill, Birmingham, West Midlands, England, B2 5SN. Our VAT registration number is GB272938666.

1.2 You can contact us through the contact form at https://vapevapevape.co.uk/pages/contact or by email at [insert customer service email address].

1.3 These Terms and Conditions ("Terms") govern your use of this website and the sale of any products by us to you. Please read them carefully before placing an order. By using this website or placing an order, you confirm that you accept these Terms.

1.4 If you do not agree to these Terms, you must not use this website or place an order.

1.5 We may amend these Terms at any time by posting a revised version on this website. The Terms in force at the time you place an order are the ones that apply to that order. Please check this page before each purchase.

2. Age restriction — strictly over 18s

2.1 It is against the law to sell nicotine-containing products, including e-liquids, vaping devices, pods, refills and nicotine pouches, to anyone under the age of 18 in the United Kingdom.

2.2 By placing an order you confirm that you are aged 18 or over and that you are legally permitted to purchase the products you have selected.

2.3 We operate a Challenge 25 policy. We use electronic age verification checks at checkout and may also require proof of age on delivery. Where an order cannot be age-verified electronically, we may ask you to supply a copy of a valid photographic ID (such as a passport or UK driving licence) before we dispatch it. Any identity document supplied for this purpose is used only to verify your age and is handled in accordance with our Privacy Policy.

2.4 It is an offence for an adult to buy, or attempt to buy, nicotine products on behalf of someone under the age of 18 (a "proxy purchase"). We will refuse or cancel any order where we believe a proxy purchase is taking place.

2.5 We reserve the right to refuse, cancel or refund any order at our discretion where age cannot be satisfactorily verified, and to refuse delivery where the person accepting the parcel cannot provide proof of age. Orders refused on this basis will be refunded less any carriage costs reasonably incurred.

2.6 Age of sale requirements are subject to change under UK legislation. Where the law changes, the age restriction applied at the time of your order will be the one required by law on that date.

3. Health, safety and product information

3.1 Nicotine is an addictive substance. Products sold on this website that contain nicotine are intended for use by existing adult smokers and vapers only. They are not intended for use by non-smokers, non-nicotine users, people under 18, pregnant or breastfeeding women, or people with heart conditions, high blood pressure, diabetes, epilepsy or any other medical condition affected by nicotine. If in doubt, consult a doctor before use.

3.2 Our products are general consumer products. They are not licensed medicines and are not sold as, or intended to be, smoking cessation aids or treatments for any medical condition. No statement on this website should be taken as medical advice.

3.3 Nicotine-containing liquids and pouches must be kept out of the reach of children and pets. Nicotine can be harmful or fatal if swallowed or absorbed through the skin. In case of accidental ingestion or contact, seek medical advice immediately.

3.4 You must read and follow the manufacturer's instructions, warnings and safety information supplied with each product before use, including all instructions relating to charging, battery care, use of the correct charger, storage and disposal. We are not liable for damage, injury or loss caused by misuse, modification, incorrect charging, use of incompatible batteries, chargers or components, or failure to follow manufacturer instructions.

3.5 E-liquids, pods and vaping devices supplied by us are intended to comply with the Tobacco and Related Products Regulations 2016 as they apply in Great Britain, including limits on nicotine strength, bottle size and tank capacity, and applicable notification requirements.

3.6 Product images are for illustration only. Packaging, flavour naming, labelling and device design may be updated by manufacturers without notice, and the product you receive may differ in appearance from the image shown. Nicotine strengths, flavour descriptions and puff counts are stated by the manufacturer and are approximate.

4. Your account

4.1 You do not need an account to place an order, but if you create one you are responsible for keeping your login details confidential and for all activity carried out under your account.

4.2 You must provide accurate, current information when registering and keep it up to date. You must not create an account using another person's details, or allow a person under 18 to access or use your account.

4.3 We may suspend, restrict or close an account at any time where we reasonably believe these Terms have been breached, where age cannot be verified, or where we suspect fraudulent, abusive or unlawful activity.

5. Orders and how a contract is formed

5.1 Our listing of products on this website is an invitation to treat, not an offer. Your order is an offer to buy from us.

5.2 After you place an order you will receive an acknowledgement email confirming that we have received it. This is not acceptance of your order.

5.3 A binding contract is formed only when we send you a dispatch confirmation email confirming that the products have been despatched. Where an order contains several items, the contract relates only to the items confirmed as despatched.

5.4 We may decline or cancel an order, in whole or in part, for any of the following reasons: the product is out of stock; age verification has failed; a pricing or description error has been identified; we suspect fraud, resale in breach of these Terms, or breach of quantity limits; we are unable to deliver to your address; or supplying the order would be unlawful. If we cancel an order after payment has been taken, we will refund you in full.

5.5 We may apply maximum quantity limits per order, per customer or per household, and may cancel orders that exceed them.

6. Prices and payment

6.1 Prices are shown in pounds sterling (GBP) and include VAT at the applicable rate. Delivery charges are shown separately and are confirmed at checkout before you complete your order.

6.2 Prices, promotions and product availability may change at any time before you place an order. Changes will not affect an order we have already confirmed as despatched.

6.3 Despite our best efforts, a small number of products may be incorrectly priced. If the correct price is higher than the price shown, we will contact you before dispatch to ask whether you wish to proceed at the correct price or cancel. If a pricing error is obvious and could reasonably have been recognised as a mispricing, we are not obliged to supply the product at the incorrect price.

6.4 We accept the payment methods displayed at checkout, which currently include Visa, Mastercard, American Express, PayPal, Apple Pay and Google Pay. Payment is taken at the point of order. Card payments are processed by our payment providers; we do not store full card details.

6.5 All products remain our property until we have received payment in full and they have been delivered to you.

7. Delivery

7.1 We deliver to addresses within the United Kingdom. We do not deliver to addresses outside the UK unless expressly stated at checkout.

7.2 Delivery options, estimated timescales and charges are shown at checkout and on our Shipping and Delivery page. Delivery estimates are estimates only and are not guaranteed. Timescales may be affected by carrier delays, adverse weather, bank holidays and other events outside our control.

7.3 We cannot deliver to PO Box addresses, and some carriers apply restrictions to certain postcodes and to the transport of products containing lithium batteries.

7.4 Someone aged 18 or over must be available to receive the delivery. Our carriers may request proof of age and may refuse to hand over the parcel if it cannot be provided. Parcels refused for this reason will be returned to us and refunded less carriage costs reasonably incurred.

7.5 Where you authorise delivery without a signature, or ask for a parcel to be left in a safe place or with a neighbour, you accept responsibility for the parcel from the point of delivery to that location.

7.6 Risk in the products passes to you when the products are delivered to the address you provided.

7.7 If delivery is delayed by an event outside our control, we will let you know as soon as possible and take steps to minimise the delay. If the delay is substantial, you may contact us to cancel the order and receive a refund for any products not received.

7.8 If nobody is available to accept delivery and the products cannot be left safely, the carrier will follow its own redelivery and collection procedure. If the products are returned to us as undelivered, we will refund the price of the products less the delivery costs and any return carriage costs reasonably incurred.

7.9 If you believe an order has arrived incomplete, damaged or incorrect, please tell us within 48 hours of delivery so that we can investigate promptly with our carrier.

8. Your right to cancel (consumers)

8.1 This clause 8 applies only if you are a consumer buying for purposes wholly or mainly outside your trade, business, craft or profession. It does not apply to business or trade customers (see clause 11).

8.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you may cancel your order and return the products within 14 days of the day after you receive them, without giving a reason. This is separate from, and in addition to, your rights in respect of faulty products.

8.3 To cancel, contact us using the contact form on our website or by email, making a clear statement that you wish to cancel and quoting your order number. You may use the model cancellation form set out at the end of these Terms, but you do not have to.

8.4 After telling us you wish to cancel, you must return the products to us without undue delay and in any event within 14 days. You are responsible for the cost of returning the products unless they are faulty, damaged or incorrectly supplied, or unless we have stated otherwise (for example under any returns promotion we operate).

8.5 Exception for sealed goods. For health protection and hygiene reasons, the right to cancel does not apply to sealed products that have been unsealed after delivery. This includes e-liquids, pre-filled pods, disposable and pre-filled devices, nicotine pouches, coils, cartridges, drip tips and mouthpieces. You may still cancel these products if they remain sealed and unused in their original, undamaged packaging and any tamper-evident seal or shrink wrap is intact.

8.6 You may handle products only as you would in a shop. If the value of a returned product is reduced because you have handled it more than was necessary to check its nature, characteristics and functioning, we may deduct an amount reflecting that reduction from your refund.

8.7 We will refund the price paid for returned products, and the standard delivery charge for the order, within 14 days of receiving the products back or receiving proof that you have sent them, whichever is earlier. If you chose a premium delivery service, we refund only the cost of our standard delivery option. Refunds are made to the original payment method.

8.8 Returns should be sent to the returns address we provide when you contact us. Please do not send products back without contacting us first, as this may delay your refund. We recommend using a tracked service and obtaining proof of postage.

9. Faulty, damaged or incorrect products

9.1 We are under a legal duty to supply products that are as described, fit for purpose and of satisfactory quality. Nothing in these Terms affects your legal rights under the Consumer Rights Act 2015.

9.2 As a summary of your key rights as a consumer: if a product is faulty, you may reject it and claim a full refund within 30 days of delivery. After 30 days, and for up to six months, you may ask for a repair or replacement, or a refund if repair or replacement is not possible or is unsuccessful. After six months, you may still have rights, but you may be asked to show the fault was present at delivery. Nothing in this summary limits your statutory rights.

9.3 Please contact us as soon as you become aware of a fault, with your order number and a description and, where possible, photographs of the issue. We may ask you to return the product so it can be inspected. Where a product is confirmed faulty, we will cover reasonable return postage costs.

9.4 Vaping devices are covered by the manufacturer's warranty where one is provided. Consumable parts, including coils, pods and batteries, are subject to normal wear and have a limited working life; deterioration through normal use is not a fault.

9.5 We are not obliged to provide a refund, repair or replacement where a fault results from accidental damage, misuse, neglect, unauthorised modification, use of incompatible components or chargers, failure to follow manufacturer instructions, or normal wear and tear.

10. Promotions, discount codes and loyalty rewards

10.1 Promotions, discount codes, multibuy offers, free gifts and loyalty or rewards points are offered subject to availability and to any additional terms published with them.

10.2 Unless stated otherwise: only one discount code may be used per order; codes cannot be exchanged for cash, applied retrospectively, or used in conjunction with other offers; and codes may be withdrawn or amended at any time.

10.3 Loyalty points and reward balances have no cash value, are not transferable, and are issued and redeemed subject to the terms published on our Loyalty and Rewards page. We may vary, suspend or withdraw a loyalty scheme, and may cancel points obtained through error, abuse or fraud, or on cancelled or refunded orders.

10.4 Where an order that earned a discount, free gift or points is cancelled or returned in part, we may adjust the refund to reflect the value of any benefit received, or require the return of any free gift.

11. Business and trade customers

11.1 If you are buying in the course of a business, for resale, or as a trade or wholesale customer, clauses 8 and 9 (consumer cancellation and consumer remedies) do not apply to you, and the following applies instead.

11.2 You must inspect the products on delivery and notify us of any shortage, damage or discrepancy within 48 hours of delivery, and of any latent defect within 7 days of discovery. We will, at our option, replace or refund products confirmed to be defective.

11.3 Except as set out in clause 11.2, we give no warranties, conditions or other terms in relation to the products, and all terms implied by statute or common law are excluded to the fullest extent permitted by law.

11.4 You confirm that you are authorised to sell age-restricted nicotine products and that you will comply with all applicable laws in reselling them, including age-of-sale, labelling, notification, display, advertising and duty requirements. You will not resell products to anyone under 18, or in any territory where the products do not meet local regulatory requirements.

11.5 You will indemnify us against any loss, damage, claim, fine or cost we incur arising from your breach of clause 11.4.

11.6 Our total liability to a business customer in connection with any order is limited to the price paid for that order. We are not liable to business customers for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss.

12. Recycling and disposal

12.1 Electrical products and batteries must not be disposed of in household waste. Please recycle used devices, batteries, pods and packaging responsibly at an appropriate collection point.

12.2 As a UK distributor of electrical equipment and portable batteries, we participate in producer compliance arrangements for waste electrical and electronic equipment and waste batteries. Contact us for information on returning waste equipment or batteries to us for recycling.

13. Use of this website

13.1 You may use this website only for lawful purposes. You must not use it in any way that breaches applicable law, is fraudulent, or has a fraudulent or harmful purpose or effect.

13.2 You must not misuse this website by knowingly introducing viruses or other malicious material, attempting to gain unauthorised access to it, or attacking it via denial-of-service or similar means. You must not scrape, data-mine or systematically extract content from the website for commercial purposes without our written consent.

13.3 We do not guarantee that this website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of the website for business or operational reasons.

13.4 We make reasonable efforts to keep product information, pricing and stock availability accurate and up to date, but the content of this website is provided for general information only and without warranties of any kind.

14. Intellectual property

14.1 All intellectual property rights in this website and its content, including text, layout, graphics, logos and images, are owned by us or licensed to us. You may view, download and print content from this website for your own personal, non-commercial use only.

14.2 Third-party brand names, logos and trade marks displayed on this website belong to their respective owners and are used to identify the products we sell. Their appearance does not imply any endorsement of us by those owners.

15. Reviews and user content

15.1 If you submit a review, comment, image or other content to this website, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business.

15.2 Content you submit must be your own, must be accurate, must not be unlawful, offensive, defamatory or misleading, and must not encourage use of nicotine products by anyone under 18 or by non-nicotine users.

15.3 We may edit, refuse to publish or remove any submitted content at our discretion, including content that does not comply with UK advertising rules applicable to nicotine products.

16. Our liability to consumers

16.1 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss or damage that is not foreseeable.

16.2 We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products, and for defective products under the Consumer Protection Act 1987.

16.3 We are not liable for business losses. If you use the products for any commercial or business purpose, our liability to you is as set out in clause 11.

17. Events outside our control

17.1 We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including strikes, carrier failure, supply chain disruption, fire, flood, severe weather, epidemic, civil unrest, failure of public or private telecommunications networks, and changes in law or regulatory action affecting the products.

17.2 If such an event occurs, our obligations are suspended for its duration, and we will let you know. If the event continues for more than 30 days, either party may cancel the affected order and we will refund any sums paid for products not supplied.

18. Privacy and data protection

18.1 We process personal data in accordance with our Privacy Policy, which explains what we collect, why, and what your rights are under UK data protection law.

18.2 Marketing emails and messages are sent only where you have given consent or where we are otherwise permitted to contact you. You can opt out at any time using the unsubscribe link in any message or by contacting us.

19. Complaints and dispute resolution

19.1 If something has gone wrong, please contact us first using the contact form on our website so we can try to resolve it. We aim to acknowledge complaints within 5 working days.

19.2 If we cannot resolve your complaint, you may be able to refer it to an alternative dispute resolution provider, or to take the matter to court. Nothing in these Terms affects your right to do so.

20. General

20.1 Transfer of rights. We may transfer our rights and obligations under these Terms to another organisation. You may not transfer yours without our written consent.

20.2 Severability. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in full force.

20.3 Waiver. If we delay in enforcing any part of these Terms, that does not prevent us from enforcing it later.

20.4 Third parties. These Terms are between you and us. No other person has any rights to enforce them.

20.5 Entire agreement. These Terms, together with our Privacy Policy, Delivery Information and Returns Policy, form the entire agreement between us in relation to your order.

20.6 Governing law. These Terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live.
