1. Legal Acknowledgement
1.1 Age restriction
This website sells age-restricted products. It is unlawful for us to sell vaping products, e-liquids, nicotine pouches and other consumer nicotine products to any person under the age of 18, and unlawful for any adult to purchase them on behalf of a person under 18 (proxy purchasing).
By placing an order you confirm that:
- you are aged 18 or over;
- you are purchasing for your own use or for lawful resale, and not on behalf of anyone under 18;
- the information you provide for age verification purposes is accurate and relates to you.
We operate a Challenge 25 approach and use electronic age verification at checkout. We may also require additional proof of age before an order is dispatched. Where age cannot be verified, we reserve the right to cancel the order and issue a refund. Deliberately supplying false information to obtain age-restricted goods may constitute a criminal offence.
Where a courier requires an adult signature on delivery, it is your responsibility to ensure an adult aged 18 or over is available to receive the parcel.
1.2 Health and safety acknowledgement
You acknowledge that:
- nicotine is a highly addictive substance;
- our products are intended only for existing adult smokers and vapers;
- our products are not intended for non-smokers, former smokers, persons under 18, pregnant or breastfeeding women, or persons with heart conditions, high blood pressure, diabetes, epilepsy or any other medical condition affected by nicotine;
- if you have any doubt about whether these products are suitable for you, you should seek advice from a qualified medical professional before use;
- e-liquid and nicotine products must be kept out of the reach of children and pets, stored in their original packaging away from heat and direct sunlight, and used strictly in accordance with the manufacturer's instructions;
- lithium batteries, chargers and vaping devices carry inherent risks if misused, damaged, over-charged or used with incompatible components, and you assume responsibility for their safe use, charging, storage and disposal.
1.3 No medical or professional advice
Our products are consumer goods. They are not medicinal products and are not licensed or marketed as smoking-cessation aids or as a treatment for any condition. Nothing on this website — including product descriptions, blog content, FAQs or correspondence from our team — constitutes medical, legal, financial or other professional advice, and it should not be relied upon as such.
1.4 Product compliance
We supply products that, to the best of our knowledge and on the basis of information provided by our suppliers and manufacturers, comply with applicable UK law, including (as relevant) the Tobacco and Related Products Regulations 2016, the Tobacco and Vapes Act 2026, the General Product Safety Regulations 2005, applicable GB CLP labelling requirements, and the Waste Electrical and Electronic Equipment Regulations.
Product specifications, images, packaging and formulations are subject to change by the manufacturer without notice. Where the manufacturer updates packaging or presentation, the item supplied may differ in appearance from the image shown.
1.5 Trade, bulk and resale purchases
Where you purchase in bulk or for the purposes of resale, you acknowledge that you are solely responsible for your own regulatory compliance, including age-of-sale verification with your own customers, correct storage and display, duty and tax obligations on vaping products, and any registration or licensing requirements applying to your business. You agree not to resell or supply our products to any person under the age of 18 or in breach of any applicable law.
1.6 International and cross-border orders
The legality of vaping products, e-liquids and nicotine pouches varies significantly between countries. Where we accept an order for delivery outside the United Kingdom, you are solely responsible for confirming that the goods may lawfully be imported into, and possessed in, the destination country, and for all import duties, taxes and customs charges. We accept no liability for goods seized, delayed or destroyed by customs or any other authority, or for any penalty imposed on you in connection with such an order.
1.7 Website content and availability
We take reasonable care to ensure the information on this website is accurate and up to date, but we do not warrant that it is complete, error-free or uninterrupted. Pricing and stock availability are subject to change, and we reserve the right to correct obvious errors and to decline or cancel any order prior to dispatch.
2. Governing Law and Jurisdiction
2.1 Governing law
These Terms, any contract formed between us, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.
2.2 Jurisdiction
The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim, save that:
- if you are a consumer resident in Scotland, you may bring proceedings in either the Scottish courts or the courts of England and Wales;
- if you are a consumer resident in Northern Ireland, you may bring proceedings in either the Northern Irish courts or the courts of England and Wales;
- if you are a consumer resident outside the United Kingdom, nothing in these Terms removes any protection or right to bring proceedings in your country of residence that you have under the mandatory law of that country.
2.3 Your statutory rights
Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
2.4 Severability
If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
2.5 No waiver
No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that or any other right or remedy, and no single or partial exercise shall prevent any further exercise.
2.6 Third party rights
A person who is not a party to a contract formed under these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its provisions.
2.7 Entire agreement
These Terms, together with our Privacy Policy, Delivery Policy and Returns and Refunds Policy, constitute the entire agreement between you and us in relation to their subject matter and supersede all prior statements, representations and understandings, save that nothing here excludes liability for fraudulent misrepresentation.
2.8 Changes to these Terms
We may amend these Terms from time to time to reflect changes in law, regulation or our business practices. The version in force at the time you place an order is the version that applies to that order. The "last updated" date at the top of this page shows when the current version took effect.
2.9 Complaints and dispute resolution
If you have a complaint, please contact us in the first instance here- https://vapevapevape.co.uk/pages/contact and we will aim to resolve the matter promptly. If we are unable to resolve your complaint to your satisfaction, you may be entitled to refer it to an alternative dispute resolution provider or to your local Trading Standards service. Referring a complaint to ADR does not affect your right to bring court proceedings.
